Ignition Interlock Device Now Required for Diversion in Oregon

There is an important 2012 update to the requirements for DUI defendants to enter diversion.  As of 2012, all criminal defendants entering into the DUI Diversion program will be required to have an ignition interlock device (IID) installed in their vehicle.  In the past, IIDs were only required for individuals convicted of DUI.  As such, you should be prepared to have an interlock device installed on your vehicle if you plan on entering the DUII diversion program.

House Bill 3075 requires that all individuals who are eligible for diversion to install an IID in their vehicle for the duration of the diversion program which typically runs for one year.  An IID prevents a vehicle from starting unless the driver provides an alcohol free breath sample.  The device costs between $70 and $100 per month to rent.  A DUI defendant is required to have the IID installed on their vehicle and is responsible for paying the installation and rental cost as well as additional maintenance fees and data downloading fees.

The new 2012 mandatory Diversion Requirements greatly increase the costs and burden of those entering diversion.
