The Law Offices of Paul F. Sherman

Portland Divorce and Family Law Attorney

Experienced Temporary Relief Lawyer

Any party to a divorce, legal separation or paternity case, may petition the court for an award of "temporary relief."

Courts generally refer to this as "pendente lite" relief. A pendente lite relief request is framed through an Order to Show Cause and is used to address issues such as temporary custody, family support, child support, spousal support, possession of the family residence, use of vehicles and other issues which need to be addressed prior to entry of the final judgment. The temporary relief may be entered by stipulation or order of the court in the form of a Limited Judgment to remain in effect until entry of a General Judgment or further order of the court.

A motion may also be made for "suit money" to pay for attorneys and experts to move the case forward towards resolution. Such motions are especially useful where one party has exercised control over all of the party's finances.
